These Terms and Conditions govern your use of FB Picker, a Facebook comment picker for giveaways and contests available at fbpicker.com. By creating an account or using the service, you agree to these terms. If you don't agree, please don't use FB Picker. Questions can go to [email protected].
1. The service
FB Picker lets you pick random winners from the comments on a Facebook post. You provide a post link, set your rules, and the tool draws one or more winners for you. We work to keep the service accurate and available, but we provide it "as is" and can't guarantee it will be free of interruptions or errors at all times.
2. Eligibility and accounts
You must be old enough to form a binding contract in your country to use FB Picker. If you create an account, you're responsible for the information you provide and for keeping your login details secure. Anything done through your account is your responsibility, so let us know right away if you think someone else is using it.
3. Free trials
FB Picker includes 3 free trials so you can test the tool before paying. Trials are meant for genuine evaluation. We may limit or end trial access if we see it being abused, for example through repeated sign-ups to avoid paying. After your trials are used, continuing to use the full service requires a paid plan.
4. Plans and payment
Details of our paid plans and prices are shown on the pricing page. By subscribing, you authorise us (through our payment processor) to charge the fees for the plan you choose. Unless stated otherwise, subscriptions renew automatically for the same period until you cancel. You can cancel at any time, and your plan will stay active until the end of the period you've already paid for. Prices may change, but we'll give you notice before a change affects you.
5. Refunds
If you're unhappy with a paid plan, contact us at [email protected], and we'll look at your situation. Any refund terms specific to a plan will be described at the point of purchase or on the pricing page. Free trials are provided at no cost and aren't refundable, since there's nothing to refund.
6. Acceptable use
You agree to use FB Picker lawfully and honestly. You must not use the service to break Facebook's rules, run fraudulent or misleading giveaways, harass anyone, scrape data for purposes unrelated to your own draw, or try to break, overload, or reverse-engineer the tool. You're responsible for making sure your giveaway follows the rules of Facebook and any laws that apply where you and your entrants live, including rules about prizes and promotions.
7. Your giveaways
FB Picker is a tool that selects a winner. Running the giveaway itself, including setting the rules, awarding prizes, handling entrant questions, and following the law, is your responsibility. We're not a party to your giveaway and aren't responsible for disputes between you and your entrants or winners. You agree to hold us harmless from claims arising out of how you run your promotion.
8. Intellectual property
FB Picker, including its software, design, and branding, belongs to us or our licensors. These terms don't give you ownership of any part of the service. You may use FB Picker as intended, but you can't copy, resell, or redistribute it without our permission. Your account details and the content of your own posts remain yours.
9. Third-party services
FB Picker relies on Facebook's platform and on other providers such as payment processors. We aren't responsible for those third parties or for changes they make that affect how FB Picker works. If Facebook changes its rules or access, some features may change or stop working, and that's outside our control.
10. Disclaimers and liability
To the extent the law allows, FB Picker is provided without warranties of any kind. We don't promise the service will meet every need or be available without interruption. We aren't liable for indirect, incidental, or consequential losses, and our total liability to you for any claim is limited to the amount you paid us in the twelve months before the claim. Some places don't allow certain limits, so parts of this section may not apply to you.
11. Suspension and termination
We may suspend or close your account if you break these terms or use the service in a way that harms FB Picker or others. You can stop using FB Picker and close your account at any time. When your account ends, your right to use the service ends too, though sections meant to survive (such as payment obligations and liability limits) will continue to apply.
12. Changes to these terms
We may update these terms from time to time. When we make important changes, we'll update the date above and, where appropriate, notify you. Continuing to use fbPicker after a change means you accept the updated terms.
13. Governing law
These terms are governed by the laws of the jurisdiction in which FB Picker operates, without regard to conflict-of-law rules. Any dispute will be handled in the courts of that jurisdiction, unless the law where you live gives you the right to a local venue.
